Scope<\/h2>\n

This notice applies only to California residents<\/strong> and supplements our general Privacy Policy. It describes the categories of personal information FITMAX INC. collects, where it comes from, why we use it, who we disclose it to, and the rights you have under the California Consumer Privacy Act as amended by the California Privacy Rights Act.<\/p>\n

It does not apply to information about our own job applicants and employees acting in that capacity, to publicly available government records, or to deidentified or aggregated data that can no longer reasonably be linked to you. Where a conflict exists between this notice and our general Privacy Policy, this notice controls for California residents.<\/p>\n

Categories of Personal Information We Collect<\/h2>\n

In the past twelve months we have collected the following categories:<\/p>\n

• Identifiers<\/strong> \u2014 name, billing and shipping address, email address, telephone number, account username, IP address, and device or cookie identifiers;<\/li>\n
• Customer records<\/strong> \u2014 order history, payment method type and last four digits, and signature or delivery confirmation on freight shipments;<\/li>\n
• Commercial information<\/strong> \u2014 products purchased or returned, cart and wishlist contents, warranty claims, replacement-part requests, and service tickets;<\/li>\n
• Internet or network activity<\/strong> \u2014 pages and product listings viewed, search terms, referring URL, session duration, clicks, and interactions with our emails;<\/li>\n
• Geolocation data<\/strong> \u2014 approximate location inferred from IP address, and delivery-zone data used to quote freight and liftgate service. We do not collect precise GPS location;<\/li>\n
• Audio, electronic, and visual information<\/strong> \u2014 support call recordings where disclosed, chat transcripts, and photos or video you send us for a damage or warranty claim;<\/li>\n
• Professional or business information<\/strong> \u2014 company name, resale or tax-exemption status, and facility type for gym, hotel, school, and dealer accounts;<\/li>\n
• Inferences<\/strong> \u2014 preferences and interests drawn from the above, such as an interest in strength equipment versus cardio, or likelihood of a light-commercial purchase.<\/li>\n<\/ul>\n

  We do not<\/strong> intentionally collect sensitive personal information for the purpose of inferring characteristics, and we do not collect biometric identifiers, precise geolocation, health records, or information about a consumer’s sexual orientation. Government identifiers are collected only where required for tax-exemption or dealer verification. We do not knowingly collect personal information from consumers under 16 years of age.<\/p>\n

  • Directly from you \u2014 checkout, account registration, newsletter signup, quote and dealer applications, reviews, warranty claims, email, chat, and phone;<\/li>\n
  • Automatically from your device \u2014 cookies, pixels, server logs, and similar technologies described in our Cookie Policy;<\/li>\n
  • From service providers \u2014 payment processors and fraud-screening tools, freight carriers and installers, our ecommerce and hosting platform, and email and analytics providers;<\/li>\n
  • From advertising and marketing partners \u2014 campaign, referral, and conversion data;<\/li>\n
  • From business customers and dealers who provide contact details for their staff or delivery sites.<\/li>\n<\/ul>\n

    Purposes of Use<\/h2>\n

    We use personal information to process and fulfill orders, arrange freight and delivery appointments, take payment and prevent fraud, handle returns, warranty claims, and replacement parts, provide customer and technical support including assembly guidance, operate and secure the site, maintain records required by tax and consumer-protection law, analyze and improve our catalog and site performance, send transactional messages and \u2014 with your consent where required \u2014 marketing communications, measure advertising effectiveness, and defend against legal claims.<\/p>\n

    We retain each category only as long as necessary for these purposes, then delete or deidentify it. Order, tax, and warranty records are generally retained for the length of the applicable warranty plus the statutory record-keeping and limitations periods; marketing contact data is retained until you unsubscribe or become inactive.<\/p>\n

    Categories of Third Parties We Disclose To<\/h2>\n

    For the business purposes described above, we disclose personal information to:<\/p>\n

    • Payment processors, fraud-prevention and identity-verification providers;<\/li>\n
    • Freight carriers, parcel carriers, warehouses, drop-ship suppliers, and installation partners;<\/li>\n
    • Ecommerce platform, hosting, CDN, backup, and IT security providers;<\/li>\n
    • Customer support, helpdesk, review, and communications platforms;<\/li>\n
    • Analytics and advertising partners, subject to your opt-out choices;<\/li>\n
    • Professional advisors \u2014 accountants, auditors, and attorneys;<\/li>\n
    • Government authorities and other parties where required by law, subpoena, or valid legal process, or to protect our rights, property, or the safety of any person;<\/li>\n
    • An acquirer or successor in connection with a merger, financing, reorganization, or sale of assets.<\/li>\n<\/ul>\n

      Service providers and contractors are bound by written agreements limiting them to processing the information for our specified purposes.<\/p>\n

      Sale or Sharing of Personal Information<\/h2>\n

      FITMAX does not sell personal information in exchange for money.<\/strong> We have not sold personal information for monetary consideration in the past twelve months, and we do not do so today.<\/p>\n

      However, when advertising and analytics cookies are active, our use of those tools may constitute “sharing<\/strong>” for cross-context behavioral advertising, and may qualify as a “sale” for other-than-monetary consideration, under California law. The categories that could be involved are limited to identifiers, internet or network activity, commercial information, approximate geolocation, and inferences. You may opt out at any time using the mechanisms described below; we also honor the Global Privacy Control signal sent by your browser.<\/p>\n

      We do not<\/strong> sell or share the personal information of consumers we know to be under 16 years of age.<\/p>\n

      Your California Privacy Rights<\/h2>\n

      • Right to Know<\/strong> \u2014 request the categories and specific pieces of personal information we have collected about you, the sources, our purposes, and the categories of third parties to whom we disclosed it, covering the 12-month period before your request or, where feasible, a longer period;<\/li>\n
      • Right to Delete<\/strong> \u2014 request deletion of personal information we collected from you, subject to exceptions such as completing a transaction, honoring a warranty, detecting fraud, or complying with a legal obligation;<\/li>\n
      • Right to Correct<\/strong> \u2014 request correction of inaccurate personal information we maintain about you;<\/li>\n
      • Right to Opt Out of Sale or Sharing<\/strong> \u2014 direct us to stop sharing your personal information for cross-context behavioral advertising;<\/li>\n
      • Right to Limit Use of Sensitive Personal Information<\/strong> \u2014 we do not use or disclose sensitive personal information beyond the purposes permitted without a limitation right, so no separate limitation request is required; if that changes, we will offer the control here;<\/li>\n
      • Right to Non-Discrimination<\/strong> \u2014 we will not deny you goods or services, charge different prices, or provide a different level of quality because you exercised a privacy right. Any financial incentive we offer will be disclosed and reasonably related to the value of the data;<\/li>\n
      • Right to Data Portability<\/strong> \u2014 receive the information you requested under the Right to Know in a readily usable, portable format where technically feasible.<\/li>\n<\/ul>\n

        How to Exercise Your Rights<\/h2>\n

        Submit a request by email to info@fitmax.com<\/strong> with the subject line “California Privacy Request,” or call +1 (805) 383-6266<\/strong>. Tell us which right you are exercising and the email address, phone number, or order numbers associated with your information.<\/p>\n

        We will acknowledge your request within 10 business days<\/strong> and respond substantively within 45 calendar days<\/strong>, extendable by a further 45 days with notice to you. Requests are free unless they are excessive or repetitive.<\/p>\n

        To protect your data we must verify your identity<\/strong> before acting. Verification normally means matching two or three data points you supply \u2014 such as the email on the account, an order number, and the shipping ZIP code \u2014 against our records. Requests for specific pieces of personal information require a higher degree of certainty and may require a signed declaration under penalty of perjury. If we cannot verify you, we will explain why and, where possible, treat a deletion request as an opt-out request instead. Verification information is used only for that purpose and then deleted.<\/p>\n

        To opt out of sharing for advertising, you may email us as above, adjust cookie and browser settings as described in our Cookie Policy, or enable Global Privacy Control in a supporting browser. Opt-out requests do not require identity verification.<\/p>\n

        Authorized Agents<\/h2>\n

        You may use an authorized agent to submit a request on your behalf. The agent must provide written, signed permission from you, and we may still contact you directly to confirm the authorization and to verify your identity, unless the agent holds a valid power of attorney under California Probate Code sections 4000 to 4465. Agents must also register with the California Secretary of State where applicable. We may deny a request from an agent who cannot demonstrate authority.<\/p>\n

        Shine the Light<\/h2>\n

        California Civil Code section 1798.83, the “Shine the Light” law, permits California residents to request once per calendar year a list of the categories of personal information we disclosed to third parties for their own direct marketing purposes in the preceding calendar year, together with the names and addresses of those third parties. FITMAX does not disclose personal information to third parties for their own direct marketing use.<\/strong> To make a Shine the Light request anyway, email info@fitmax.com with the subject line “Shine the Light Request.”<\/p>\n
