Acceptance of Terms & Eligibility
These Terms of Use (“Terms”) form a binding agreement between you and FITMAX INC. (“FITMAX,” “we,” “us,” or “our”) and apply to www.fitmax.com and every order placed through it. By browsing the site, creating an account, or completing a purchase, you accept these Terms in full. If you do not agree, please stop using the site.
You must be at least 18 years of age and legally able to enter into a contract to place an order or open an account. If you are between 13 and 18, you may use the site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We do not knowingly permit anyone under 13 to register or transact.
If you use the site on behalf of a business, gym, hotel, school, or other organization, you represent that you are authorized to bind that entity, and “you” includes that entity.
Use of the Site
You may browse the site, place orders, and download product manuals and specification sheets for your own personal or internal business use. Any other use requires our prior written permission.
You agree not to:
- Copy, scrape, mirror, or republish site content, product photography, or product descriptions for commercial purposes;
- Resell FITMAX products as an authorized dealer without a signed dealer agreement, or misrepresent yourself as affiliated with FITMAX;
- Use bots, crawlers, automated ordering scripts, or bulk-purchase tools to buy limited-stock or promotional items;
- Attempt to probe, scan, or breach site security, interfere with checkout, or introduce malware;
- Submit false, stolen, or unauthorized payment or shipping information;
- Abuse promotional codes, referral credits, or return privileges, including repeated “buy-and-return” cycles of the same item;
- Use the site for any unlawful purpose or in violation of any export, sanctions, or consumer-protection law.
We may suspend or terminate your account, cancel pending orders, and refuse future service if we reasonably believe you have violated these Terms.
Product Information & Pricing
We work to describe our equipment accurately, including weight capacities, footprint dimensions, plate compatibility, and assembled weight. Even so, product images are for illustration only. Finish, upholstery color, hardware, decals, and included accessories may differ from photographs, and we may improve or change components without notice. Where a specification matters to your purchase decision, confirm it with us in writing before ordering.
All prices are shown in U.S. dollars and exclude sales tax, freight surcharges, liftgate or inside-delivery fees, and any applicable duties unless expressly stated. Prices, promotions, and availability may change at any time without notice.
Despite our efforts, listings may contain typographical errors, incorrect pricing, or inaccurate stock counts. We reserve the right to correct errors and to refuse or cancel any order arising from an obvious pricing or description error, including after an order confirmation has been sent. If we cancel such an order, we will notify you and refund any amount already charged in full. Order confirmation emails are an acknowledgement of receipt, not an acceptance of your offer.
Orders, Payment & Cancellation
Your order becomes binding on us only when the item ships or when we send a separate acceptance notice. We may limit quantities per customer, per household, or per order, and we may decline orders that appear to be for unauthorized resale.
By submitting payment information you confirm you are authorized to use the payment method. Payments are processed by third-party providers; we do not store full card numbers on our servers. We may require address verification, a matching billing address, or additional identity confirmation before releasing large or freight-shipped orders.
Requests to cancel or change an order must reach us before the order enters fulfillment. Freight and drop-ship items often enter processing within hours, and once a shipment is tendered to the carrier it is governed by our Shipping Policy and Returns Policy, including any freight-return or restocking charges disclosed there.
Title and risk of loss pass to you on delivery to the address you provide. You are responsible for inspecting shipments and noting visible damage on the carrier’s delivery receipt.
Intellectual Property
The FITMAX name, the FITMAX logo, and all product names, taglines, and trade dress used on this site are trademarks or registered trademarks of FITMAX INC. All site content — text, product photography, video, illustrations, assembly manuals, layout, and code — is owned by FITMAX or its licensors and is protected by United States and international copyright and trademark law.
You may not use our marks in advertising, product listings, domain names, social handles, or metadata in any way that suggests sponsorship, endorsement, or affiliation without our written consent. All rights not expressly granted in these Terms are reserved.
User Content
You may be able to post reviews, ratings, photos, videos, questions, and other material (“User Content”). You keep ownership of your User Content, but by posting it you grant FITMAX a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, and display it in connection with our products and marketing, in any medium, with or without attribution.
You represent that you own or control all rights to your User Content, that it is accurate, and that it does not infringe any third party’s rights or contain unlawful, defamatory, obscene, or misleading material. Do not post medical claims, before-and-after weight-loss guarantees, or instructions that contradict our assembly and safety documentation.
We do not endorse User Content and are not obligated to publish or retain it. We may edit, refuse, or remove any submission at our discretion, including reviews we believe are incentivized, fraudulent, or unrelated to a genuine purchase.
Assumption of Risk & Safety
Strength training and cardio exercise involve inherent risk of serious injury or death. Free weights, barbells, plate-loaded machines, racks, benches, and cable systems can cause crush injuries, dropped-load injuries, muscle and joint damage, or cardiac events. By purchasing and using FITMAX products you knowingly and voluntarily assume all such risks.
- Consult a physician before beginning any exercise program, particularly if you are pregnant, recovering from injury or surgery, or have a heart, blood-pressure, orthopedic, or metabolic condition.
- Assemble and install exactly as documented. Follow the supplied manual, use all included hardware, apply specified torque values, and complete any required floor or wall anchoring. Racks and cable towers may require anchoring or ballast; do not substitute parts or hardware.
- Never exceed the stated maximum user weight or maximum load rating. Ratings are per-product and are published in the manual and on the product page. Overloading, dropping loaded barbells outside designated drop zones, or using equipment for a purpose it was not designed for voids the warranty and is at your sole risk.
- Use spotters, safety arms, and clips for barbell work. Inspect cables, straps, welds, fasteners, and upholstery before each session and remove damaged equipment from service.
- Supervise children and untrained users. Equipment is not a toy; store plates and small parts securely and keep the training area clear.
- Install on a level, structurally adequate surface. Verify ceiling height and floor load capacity, especially in apartments, upper floors, garages, and light-commercial spaces.
FITMAX does not provide medical, physical-therapy, or personal-training advice. Any programming, form guidance, or exercise suggestion on this site is general information only and is not a substitute for qualified professional instruction. You are solely responsible for the manner in which you and anyone you permit to access your equipment uses it.
Warranty Disclaimer
Except for the express limited warranty published in our Warranty Policy, the site and all products, content, and services are provided “AS IS” and “AS AVAILABLE” without warranty of any kind. To the fullest extent permitted by law, FITMAX disclaims all implied warranties, including merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement.
We do not warrant that the site will be uninterrupted, secure, or error-free, that product descriptions or stock information are complete and current, or that any equipment will produce a particular fitness, performance, or health result. No advice given by FITMAX personnel creates a warranty beyond the written terms of our Warranty Policy. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, FITMAX INC. and its officers, employees, suppliers, and carriers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, loss of data, loss of use, gym downtime, personal training revenue, or the cost of substitute equipment, arising out of or relating to the site, any product, or these Terms — whether based in contract, tort, strict liability, or otherwise, and even if we were advised of the possibility of such damages.
Our total aggregate liability for any claim relating to a product or order will not exceed the amount you actually paid to FITMAX for that product or order. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by our own negligence where such limitation is prohibited.
Indemnification
You agree to defend, indemnify, and hold harmless FITMAX INC. and its officers, directors, employees, agents, and suppliers from and against any claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: your use of the site or of any FITMAX product; your breach of these Terms; your User Content; your failure to assemble, anchor, inspect, or maintain equipment as documented; your exceeding a stated load or user-weight rating; or injury to any third party you allow to use your equipment.
Third-Party Links & Services
The site may link to third-party websites, payment processors, financing providers, freight carriers, installation partners, and product manuals hosted by manufacturers. Those services are operated independently and are governed by their own terms and privacy practices. We provide links for convenience only, do not control or endorse their content, and are not responsible for their acts, omissions, pricing, or data handling. Review their terms before relying on them.
Governing Law & Dispute Resolution
These Terms and any dispute arising from them or from your use of the site or our products are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing any formal action, you agree to contact us at info@fitmax.com with a written description of the dispute and to allow 30 days for good-faith resolution. If the dispute is not resolved, you and FITMAX agree to the exclusive jurisdiction and venue of the state and federal courts located in San Bernardino County, California, and each party waives any objection to that venue. Claims must be brought individually; you agree not to participate in any class, collective, or representative action, to the extent permitted by law. Nothing here prevents either party from seeking injunctive relief to protect intellectual property or from filing a claim in small-claims court where it qualifies.
Changes to These Terms
We may revise these Terms at any time. The revised version takes effect when posted, and the “Last updated” date above will change. Your continued use of the site after we post an update means you accept the revised Terms. The version in force at the time you placed an order governs that order. If any provision is found unenforceable, the remaining provisions stay in effect.
